Kyma Band preorder terms

1. What you’re preordering

A preorder reserves one Kyma Band from the Founding Batch, our first production batch, made by Kyma Neuro, Inc. (“Kyma”, “we”). Kyma Band is in development. Its final design, materials and specifications may differ from what we show today. Kyma Band is not a medical device and is not intended to diagnose, treat or prevent any condition.

2. Founding Batch early access

As a Founding Batch member, you’ll be among the first to use Kyma, and we want to build it with you. You’ll get:

• early access to new Kyma Studio features and developer tools as we release them;
• invitations to test features before they’re released, and to share feedback directly with our team; and
• updates on what we’re building, before anyone else.

Taking part is optional. What we offer, and when, may change as Kyma develops. Pre-release features may be incomplete or change before release.

3. Who can preorder

You must be at least 18 and preorder with a shipping address in the United States. Founding Batch bands are for personal use. You’re welcome to preorder one as a gift, but please don’t preorder to resell: we may cancel orders that appear to be placed for resale, and refund them in full.

4. Payment and pricing

The full Founding Batch price, $299 USD plus any applicable sales tax, is charged when you place your preorder. Payments are processed by Stripe; we never see or store your full card number. One band per order.

Sales tax is based on your shipping address. The price shown at checkout is the price you pay: if our prices change later, that doesn’t affect a preorder you’ve already placed. If we find an obvious pricing error in your order, we’ll tell you and you can choose the correct price or a full refund.

5. Shipping and delays

We expect Founding Batch bands to ship in Q1 2027, to addresses in the United States. This is an estimate, not a guarantee. If we can’t ship by the date we’ve told you, we’ll email you a revised date, and you can choose to cancel for a full refund or keep your place. If we don’t hear from you, or we can’t give a revised date, we’ll handle it as the law requires, including refunding you where it applies.

We’ll email you a tracking number when your band ships. You can update your shipping address any time before then; see our shipping policy.

6. Delivery, and lost or damaged packages

Shipping is free and at our risk: ownership and risk of loss pass to you when your band is delivered. If your package arrives damaged, or tracking shows it delivered but you didn’t receive it, email us within 7 days of the delivery date. If it hasn’t arrived within 7 days of its expected delivery date, let us know. We’ll work with the carrier and send you a replacement or refund you in full.

7. 30-day returns

Try Kyma Band for 30 days from the day it’s delivered. If it’s not for you, email contact@kymaneuro.com within those 30 days with your order number (it starts with KB-). We’ll send return instructions, and once the band is back with us we’ll refund you in full. Refunds go back to your original payment method; banks usually take 5–10 business days to show them. 8. Before it ships

Founding Batch preorders are final once placed. You’ll get a full refund before your band ships if:

• we can’t ship by the date we’ve given you and you’d rather not wait, as described in section 5;
• we make a material change to the product;
• Kyma Band doesn’t complete FCC authorization, as described in section 9; or
• we cancel your order, or can’t fulfil it.

We may cancel an order if we suspect fraud, if it was placed for resale, because of an obvious pricing error, or if we can’t fulfil it. If we cancel, we’ll tell you and refund you in full.

Nothing in these terms limits any right you have under applicable law.

9. FCC authorization

Kyma Band is subject to FCC rules and is still completing FCC equipment authorization. Delivery is conditional on completing it. FCC rules don’t address consumer protection, contract or other provisions under federal or state law. If authorization isn’t completed, we won’t ship your band and we’ll refund you in full. Your band stays the property of Kyma until it has been authorized and delivered to you.

10. Warranty

Kyma Band comes with a one-year limited warranty against defects in materials and workmanship. You can read the full limited warranty before you buy. Apart from that warranty, and to the extent the law allows, we don’t make other warranties about Kyma Band. Some states don’t allow this, so you may have additional rights.

11. Kyma Studio

Kyma Band works with Kyma Studio. Features available at shipping may differ from those shown in previews, and some features may arrive in later updates.

12. Using Kyma Band safely

Use Kyma Band as described in the instructions that come with it. Don’t wear it on broken or irritated skin, and stop using it if you notice irritation or discomfort. Kyma Band is for adults. It is not a medical device, so don’t rely on it for medical decisions.

13. Limitation of liability

To the extent the law allows, Kyma isn’t liable for indirect, incidental, special or consequential damages, such as lost profits or lost data, arising from your preorder or Kyma Band, and our total liability for any claim about your preorder is limited to the amount you paid for it. Some states don’t allow these limits, so they may not apply to you.

14. Events outside our control

We’re not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, supply chain or carrier disruptions, or government action. We’ll tell you as soon as we reasonably can. This doesn’t affect your right to cancel for a full refund if we can’t ship by the date we’ve given you (section 5).

15. Your information and emails

We use your name, email, phone and shipping address only to process your order, contact you about it and ship your band. See our privacy policy.

We’ll send notices about your preorder by email, and they count as written notice. Please keep your email address up to date. We’ll still send order emails if you unsubscribe from our announcements.

16. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. If something goes wrong, please email us first and we’ll try to resolve it with you. Any dispute we can’t resolve together will be handled in the state or federal courts in New York County, New York, though either of us may bring an eligible claim in small claims court. This doesn’t take away any consumer protection rights you have under the laws of the state where you live.

17. Changes and the rest of these terms

We may update these terms for future preorders. The version you agreed to when you preordered applies to your order. These terms, our limited warranty, returns policy, shipping policy and privacy policy make up the whole agreement for your preorder; if they conflict, these terms control. If any part of these terms can’t be enforced, the rest still applies.
